These Terms of Service ("Terms") govern your use of PixiesLabs, an AI email assistant for property managers operated by Labs by Santiago LLC ("PixiesLabs," "we," "us"). By subscribing to or using the service, you ("Customer," "you") agree to these Terms.
PixiesLabs connects to your authorized Gmail account, reads incoming tenant emails, generates draft or automatic replies using AI, and logs activity in a dashboard. The specific scope, service levels, and fees for your account are defined in your Master Service Agreement (MSA) and order form, which prevail over these Terms in case of conflict.
Replies are generated by an automated system and may contain errors. PixiesLabs does not provide legal, financial, housing, or professional advice. AI-generated replies are drafts and suggestions only. You retain final editorial control and responsibility for all communications sent from your account. You are responsible for compliance with applicable laws, including fair housing and landlord-tenant law.
The dashboard maintains time-stamped records of processed communications for your operational convenience. These records are provided "as is" and do not constitute legal evidence, certification, or legal advice.
Fees are billed monthly (or annually if elected) per your order form. A one-time setup fee applies unless waived under an annual agreement. Fees are exclusive of applicable taxes. Late payments may result in suspension of the service.
Pilots are provided at no cost for the stated period. Either party may cancel a subscription with written notice as defined in the MSA; unless otherwise stated, there is no long-term lock-in. On cancellation we revoke access and delete stored content per our Privacy Policy.
Our handling of your data and Google user data is described in our Privacy Policy, which is incorporated into these Terms. We access the Gmail inbox you authorize, with credentials stored encrypted and isolated per client, and you may revoke access at any time.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or appropriate.
To the maximum extent permitted by law, PixiesLabs and Labs by Santiago LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to the service. Our total aggregate liability for any claim will not exceed the fees you paid to us in the three (3) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless PixiesLabs and Labs by Santiago LLC from claims arising out of your use of the service, your content, or communications sent from your account.
We may update these Terms. Material changes will be posted here with a new "Last updated" date; continued use constitutes acceptance.
These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Denver, Colorado.
